The Land-Claims Process
With the 1973 Calder case and its recognition of Aboriginal Title, Canada can no longer deny that Indigenous land rights exist. It establishes two formal land claim processes to address Canada’s alienation of unceded lands and its noncompliance with treaties.
The comprehensive land claims process (often referred to as the modern treaty process) is for First Nations who never signed treaties and cases where Aboriginal Title is unsurrendered (which, in 1973, is true of the Algonquins of eastern Ontario, most of British Columbia, Quebec, the Atlantic provinces, and most of the northern territories).
The specific claims process is developed to address broken or unfulfilled treaty promises –this is the process most applicable to lands in the GTA. A look at the 2010 Toronto Purchase Specific Claim illustrates the possibility for some redress but also the limitations of the current process.

Why are we having to prove that we were the true owners of the land, and that they made the treaty? It should be the onus on the government to prove that they actually did purchase it, prove it to us that my ancestors were there at that meeting . . . In 1986, the Mississaugas of the Credit draw on documentation first gathered by Peter Jones and Dr. Peter Edmund Jones as well as later researchers to submit the Toronto Purchase Specific Claim to the Indian Claims Commission (later replaced by the more independent Special Claims Tribunal). The Mississauga successfully argue that the agreement was not properly recorded or adequately explained to their leaders, the deed was blank, and it was not signed by the appropriate representatives of the Crown. They argue that the “confirmation” of the Purchase in 1805 greatly increased the amount of land supposedly ceded in 1787 without the knowledge of the Mississauga and included the Toronto Islands, which the Mississauga assert were not included in the 1787 agreement (they were not islands at that time, but a peninsula).

Their specific claim also includes the smaller Brant Tract claim near Burlington. In both cases, the commission finds that the Crown did not provide fair compensation for the land. In 2010, the federal government agrees to pay $145 million to the Mississaugas of the Credit.
In this case, as in all specific claims, the government arbitrarily sets the cap for settlements at $150 million, although the present value of Toronto lands that were inappropriately alienated through the 1805 Toronto Purchase far exceeds that.
We got a $142 million for Toronto, and $3 million for the Brant Tract, . . . And then, there was the ultimatum. They kept land claims at $150 million and you settle or else you can just take us to court, take your choice.

The Toronto Purchase Specific Claim took over two decades of on-and-off negotiations, countless hours of preparation, and generations of leadership to reach the eventual settlement.
We go through five prime ministers, I think, in twenty-two years . . . I don’t know how many different Chiefs we went through . . . at least ten, eleven band councils, and you can see the anger rising all the time. They just think they’re going to make a breakthrough. Okay, election called. Make another breakthrough, change in minister . . . You think you’re about to get a breakthrough, and then one of the negotiators goes, and they have to train a new person to do it. It takes twenty-two years, but I think we’re resilient people, if nothing else.
